Please note that any current or future claims of any performances based on the Tsunami Pro Trader software and Tsunami Pro Strategy will not be a basis of measurement or guarantee of any future performances by any Client. Each trader is unique and therefore interprets Tsunami Pro Trader in a different way. Tsunami Systems & Strategies, Inc. provides a guideline on how to interpret Tsunami Pro Trader indicators according to our provisions and training provided but cannot accept any liability on any version of an interpretation by a Client or any losses that might be incurred due to a specific interpretation made by the Client.

Tsunami Systems & Strategies, Inc. may publish testimonials or descriptions of past performance, but the results are NOT typical, and might not be an indication of future results or performance, and are NOT intended to be a representation, claim, warranty or guarantee that similar results will be obtained by you.

Tsunami Pro Trader system generates Indicators regarding the behavior of specific Instruments selected by the Client via the Platform and based on real time data received from the Market. The Indicators are intended to inform the Client about the manner in which the Market typically behaves within predefined parameters. Tsunami Pro Trader does not consider the Client’s personal objectives, circumstances and/or needs. Moreover, there are various real-world factors or fundamentals that may influence the behavior of Instruments which Tsunami Pro Trader is unable to consider when generating Indicators. Accordingly, Tsunami Pro Trader must be utilized as a guide for good practice and the Client must consider its own objectives, circumstances or needs, before deciding to use Tsunami Pro Trader, apply the Trading Strategy as well as performing Transactions.

All Market Data is subject to change at any time and without notice. The Client acknowledges that the trading of Instruments on the Platform may become volatile very quickly and without warning. Tsunami Systems & Strategies, Inc. cannot be held liable for any loss, cost or charge incurred directly or indirectly from the performance of the Client’s Transactions and does not accept liability for any loss or damage, including, any loss of profit, which may arise directly or indirectly from use of, or reliance on the Market Data or any Indicator provided by Tsunami Systems & Strategies, Inc.

Trading is risky and making the decision to do a transaction solely vests with the Client and Tsunami Systems & Strategies, Inc. can therefore not take responsibility nor accept any liability for any transactions executed by the Client.

Tsunami Systems & Strategies, Inc. does not provide advice on the merits or suitability of any Transaction, however Tsunami Pro Trader will provide information automatically generated based on the historic behaviour of the Instruments selected by the Client.

Tsunami Pro Trader shall automatically monitor the status of the Instrument selected by the Client but does not instruct or advise the Client on any Transaction or how to proceed with such Transaction.

The methodology applied by Tsunami Pro Trader in generating the Indicators makes exclusive use of the historical data drawn by the Platform from the Market. Accordingly, all Indicators are based on historical Market Data. In the event Market Data moves outside of a historical range, the Indicators shall indicate that the level at which the Instrument is currently trading is outside the functioning parameters of Tsunami Pro Trader. The Client acknowledges and understands that past Market performance does not guarantee future Market performance.

In respect of Tsunami Pro Trader and the Trading Strategy:

Such System and Trading Strategy is provided as general commentary for the Client’s convenience, information, and training purposes only and does not constitute financial advice or investment advice or any intermediary service;

Tsunami Systems & Strategies, Inc. is in no manner whatsoever responsible or liable if any such data or information is used by the Client or any other party and any losses are incurred by the Client or any other party;

Tsunami Systems & Strategies, Inc. is not responsible or liable for any actions that the Client takes or does not take based on such data or information provided by Tsunami Pro Trader, Tsunami Pro Strategies or our training platform;

Such data or information is proprietary information of Tsunami Systems & Strategies, Inc. The Client will not retransmit, redistribute, publish, disclose, or display in whole or in part such data or information to third parties except as required by applicable regulations; and

The Client will use such data or information solely in compliance with any applicable laws and regulations in his or her respective jurisdictions.

The Client agrees that Tsunami Pro Trader contains proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that the Client will not use such proprietary content, information, or materials in any way whatsoever except for permitted use of Tsunami Pro Trader, Tsunami Pro Strategies, and our training material.

Tsunami Systems & Strategies, Inc. shall have the right to add, modify or remove any part of Tsunami Pro Trader, from time to time and at its sole discretion, without notice to the Client. The Client agrees to accept such modification and cannot constitute a claim against Tsunami Systems & Strategies, Inc. due to any such modifications.

Access to Tsunami Pro Trader may be affected from time to time by routine maintenance, repairs, reconfigurations, internet interruptions, system malfunctions, electrical outages, natural or political disasters and upgrades and in any such instances no claims can be submitted, nor any liability imposed on Tsunami Systems & Strategies, Inc. in any such event. The Client must give Tsunami Systems & Strategies, Inc. access to the Relevant Account information to perform any check or tasks that might be needed to maintain its integrity.

Tsunami Systems & Strategies, Inc. may, from time to time at its sole discretion, publish optional as well as mandatory upgrades to Tsunami Pro Trader.

Tsunami Systems & Strategies, Inc. does not make any warranty:

That Tsunami Pro Trader will be available for access all the time, or at any time on a continuous uninterrupted basis;

As to the operation, quality or functionality of Tsunami Pro Trader;

That Tsunami Pro Trader information will be accurate. Any delay or latency in the Client’s internet speed or data connection may affect the accuracy to the current Market Data as well as Tsunami Pro Trader;

That Tsunami Pro Trader will be free of errors or defects; and

That Tsunami Pro Trader is free from viruses or anything else that has contaminating or destructive properties including where such results in loss of, or corruption to, the Client’s data or other property.

To specific performances or any performances based on past performances or claimed performances by its owners, employees or any affiliated person or Client using the system for any past or future performances.

The Client agrees not to:

Use Tsunami Pro Trader for illegal or inappropriate purposes;

Interfere with or disrupt the proper operation of the Broker’s software, hardware, systems or networks, including knowingly or negligently transmitting files that may interrupt, damage, destroy or limit the functionality of any computer software, hardware, systems or networks, including corrupted files or files that contain viruses, trojan horses, worms, spyware or other malicious content;

Take any action which does or may cause the provision of Tsunami Pro Trader to other users to be interrupted or degraded;

Knowingly or negligently upload or download files that contain software or other material protected by copyright, trademarks, patents, or other intellectual property rights (or by rights of confidentiality or privacy of publicity, where applicable) unless the Client own or control the rights thereto or has received all necessary consents; or

Falsify the origin or source of any content or other material.
